11. Termination

Consumer termination rights are protected under Dutch law.

12. Limitation of Liability

To the maximum extent permitted by Dutch and EU law, Verde Vista excludes liability for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount paid by you for the specific service in the 12 months preceding the claim.

Important: This limitation does not apply to liability for death, personal injury, fraud, or gross negligence, which cannot be excluded under Dutch law.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Verde Vista from any claims, damages, or expenses arising from your unlawful use of our services or wilful breach of these Terms.

14. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures of third-party services.

15. Governing Law and Jurisdiction

These Terms are governed by Dutch law. For business users, disputes will be resolved exclusively by the competent courts in the Netherlands. For consumers, you may also bring proceedings in the courts of your country of residence.

16. Dispute Resolution

Before commencing legal proceedings, we encourage:

  • Direct contact to resolve issues amicably
  • Mediation through recognised mediation services
  • For consumer disputes: EU Online Dispute Resolution platform
  • Contact with relevant industry complaint bodies

17. Severability

If any provision of these Terms is found to be unenforceable under Dutch or EU law, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted.

18. Changes to Terms

We reserve the right to modify these Terms with reasonable notice. For material changes affecting consumers, we will provide at least 30 days' notice. Continued use after changes constitutes acceptance, subject to your legal rights to terminate.

19. Language

These Terms are provided in English. In case of conflict between different language versions, the English version shall prevail, subject to local consumer protection requirements.

20. Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Verde Vista regarding the use of our services.
